Agreement.
This contract is an agreement between the Client and “All Home Meters, LLC” to perform an inspection of a foreclosed property. Our Certificate of Use (CU) Inspection Miami Dade is a single trip generalist observation that is visual in nature and not technically exhaustive.
Client shall carefully read the proposal offered by All Home Meters, LLC, and after acceptance by the Client of the price, conditions and terms in the proposal, Client is agreeing with all the term of this agreement.
Due to Ordinance No. 08-133 Miami Dade County and Ordinance 2009-15 City of Doral, all residential properties in unincorporated Miami-Dade County and City of Doral which are acquired through a Certificate of Title (Foreclosures and Judgments), require that title holders obtain a Certificate of Use (CU) prior to offering a property for sale, transfer or alienation in accordance with Chapter 45, Florida Statutes. Residential properties affected include single-family homes, condominiums, townhouses and duplexes.
The new Certificate of Use (CU) Ordinance includes the preparation of a Disclosure of Findings Report, which identifies building or zoning code violations for such properties and contains a good faith estimate of the cost to remedy any deficiencies. This report must be completed by an architect or professional engineer licensed and registered in the State of Florida.
After acceptance from Miami Dade or City of Doral Planning and Zoning Department and properly filing with Miami Dade Clerk of Courts, Client will be provided with a new Certificate of Use (CU).
Disclamer.
This Inspection does NOT include any destructing test or dismantling.
The Engineer/Inspector will NOT inspect for any deficiency on elements or areas, which are not exposed to view, is concealed, is inaccessible, or otherwise difficult to inspect and cannot be visually examined.
The Engineer/Inspector is NOT acting or representing himself as a licensed structural engineer, electrical engineer, mechanical engineer or an expert in any craft or trade.
The Inspection is NOT intended to be technically exhaustive.
The liability of this report is limited to the cost of the inspection. The report depicted here is NOT covered by professional liability insurance.
The Inspection is NOT considered to be a guarantee, home warranty or insurance policy of the future life or failure of the items inspected,expressed or implied.
Price estimates to repair, legalize or replace any of the inspected items are only provided as informative and cannot be considered as final costs. Only certified contractors can give the final estimates.
Researches to find construction permits, construction inspections, open permits, open violation cases, open citations, liens, resolutions, etc, are NOT thorough investigations.
The Disclosure of Findings Report is only valid at the time of the inspection. Any change in the property requires another inspection.
Scope of the Inspection.
The inspection will be performed following the minimum inspection procedural guidelines established by the Miami Dade or City of Doral Planning and Zoning Departments.
Limitation from liability.
It is expressly understood and agreed to that liability for damages resulting directly from any errors and omissions in the services provided in connection with this agreement shall be limited to the fees paid. The liability of the inspectors, agents and employees is also limited to the fees paid.
Dispute resolution.
Any recovery contemplated under this agreement shall be subject to prompt notification of any defect in the performance of any of the inspector’s duties. The Client shall provide reasonable notice and permit an inspection of the conditions which gave rise to the complaint. The Client agrees to hold the Inspector harmless for any and all claims related to conditions that are altered or repaired without said notice or inspection.
Arbitration.
Unresolved disputes, except one for non- payment of fees, shall proceed to binding arbitration conducted in accordance with the industry rules and the parties will select an arbitrator who is familiar with the real estate inspection profession. The arbitrator shall conduct summary judgment motions and enforce full discovery rights as would a court and shall follow substantive rules of law.
Attorney's fees.
The prevailing party in any dispute arising out of this agreement shall be entitled to reasonable attorney fees, arbitration and other related costs.
Fees.
The Client will pay, after delivery, a fee in the amount stated in the proposal to obtain a new Certificate of Use (CU), all included: surveying, inspection, application, filing, etc, and within the next thirty (30) business days.
Final.
The inspected items will be reported based upon visual inspection and to the best of our knowledge, belief and professional judgment.
Client will provide All Home Meters, LLC with the name and address of the title holder of the property and with the access to the property.
Cient has read this agreement and Client does understand and Client does agree to all terms and conditions of this contract, thus Client does agree to pay the fee listed in the proposal and therefore Client is accepting the proposal offered by All Home Meters, LLC to perform an inspection in a foreclosed property in order to obtain a new Certificate of Use due to Ordinance 08-133 Miami Dade County and Ordinance 2009-15 City of Doral.
